The Shanghai Pudong New Area court announced on the 6th that the "WorldExpo court" of the court has successfully resolved six disputes involving the exhibition hall through pre litigation mediation since its opening more than two months ago, providing judicial guarantee for the smooth operation of the WorldExpo.
A case recently settled through mediation is related to Sri Lanka Pavilion. On May 31 this year, the WorldExpo court received a petition from China Mobile Communications Group Shanghai Co., Ltd. According to the complaint, Sri Lanka Pavilion of the WorldExpo registered a mobile phone number with the mobile company in february2009. However, since last June, Sri Lanka has not paid the mobile phone fees for this number. The mobile company requires Sri Lanka to pay the overdue mobile communication fees of RMB 468 and the corresponding liquidated damages.
After receiving the case, the WorldExpo court immediately started the "litigation mediation connection" procedure, and promptly learned about the situation from both parties. It turned out that in February last year, a staff member of the Sri Lanka Pavilion held the seal of the pavilion and applied to the mobile company for a "pay after use" mobile phone number in the name of the pavilion. However, the staff member left the Sri Lanka Pavilion shortly after. Because the mobile phone had been in arrears, the mobile company finally shut down.
On June 3 this year, the judge and the pre litigation mediator of the Expo court carefully presented the plaintiff's petition and evidentiary materials to Mr. Hubert, the general representative of the Sri Lanka Pavilion, patiently explained the specific provisions of Chinese law to him, and reminded him to pay attention to strengthening the management of personnel and seals in the future to avoid unnecessary disputes. Mr. Hubert thanked the court for the reminder, and said that he had previously neglected the management of seals and was sorry for the disputes. Under the auspices of the court, the two parties reached a settlement, and the mobile company also withdrew the lawsuit.
Not long ago, the WorldExpo court successfully resolved a dispute over compensation for personal injury during the decoration of the Saudi Arabian national pavilion through "litigation mediation connection". During the decoration of the Saudi Museum, Yang, the decorator, suffered traumatic spleen rupture due to accidental fall. After pre litigation mediation, pan, his employer, paid 135000 yuan of compensation to Yang in a lump sum.
It is understood that since its establishment on March 25 this year, the WorldExpo court has accepted 11 cases and concluded 6 cases. All cases have been settled through mediation or withdrawal. Most of these cases occurred in the Expo Park, involving goods sales, equipment leasing, construction projects and personal injury in the early stage of the construction of the Expo Park.
Chenxueming, President of the WorldExpo court, said that during the trial of WorldExpo related cases, the judge paid attention to guiding the parties to mediate before entering the proceedings. With the patient work of mediators and judges before appeal, the parties were basically willing to make mutual understanding and compromise. The settlement cycle of mediation cases is also relatively short, with an average mediation cycle of 10 days, which is conducive to the timely maintenance of the legitimate interests of relevant parties.
