On May 18, the Supreme People's Procuratorate and the Ministry of Public Security jointly issued the provisions of the Supreme People's Procuratorate and the Ministry of public security on the standards for filing and prosecuting criminal cases under the jurisdiction of public security organs (II) (hereinafter referred to as the standards for filing and prosecuting criminal cases (II)), which stipulated the standards for filing and prosecuting 86 economic crime cases under the jurisdiction of the economic crime investigation department of public security organs. The standard for filing and prosecution (II) is a legally effective guiding normative document formulated by the Supreme People's Procuratorate and the Ministry of public security in accordance with the criminal law, which provides a clear basis for the public security and judicial organs to investigate and deal with economic crime cases and crack down on economic crime activities in accordance with the law.

On april18,2001 and march5,2008, the Supreme People's Procuratorate and the Ministry of Public Security issued and implemented the provisions on the standards for the prosecution of economic crime cases and the supplementary provisions on the standards for the prosecution of economic crime cases, which provided clear and unified law enforcement norms for the public security and judicial organs to file, investigate, approve and prosecute economic crime cases. With the development of economy and society, economic crimes have been showing new features and changes, and the relevant laws and regulations related to economic management have also changed. In particular, after the implementation of the criminal law amendment (III) to the criminal law amendment (VII), many economic crimes have been added and amended. The original prosecution standards can not fully meet the needs of law enforcement, and there is a lack of prosecution standards for law enforcement. For this reason, the Supreme People's Procuratorate and the Ministry of public security, on the basis of the prosecution standards and their supplementary provisions, and in accordance with the provisions of the criminal law and the actual needs of judicial practice, jointly formulated the prosecution standards for filing cases (II), which provides a strong guarantee for the timely and accurate fight against economic crimes. The standards for filing and prosecution (II) includes the standards for filing and prosecution of 86 economic crime cases under the jurisdiction of the economic crime investigation department of the public security organ. Among them, the standards for filing and prosecution of 48 cases were newly formulated or supplemented, modified and improved by integrating various factors. For example, according to the provisions of the criminal law amendment (VII), the standards for filing and prosecution of the crime of organizing and leading pyramid selling activities were added, and the standards for filing and prosecution of the crime of tax evasion were significantly adjusted. When formulating the standards for filing cases for prosecution, we always adhere to the principles of legality, coordination, scientificity and applicability. While ensuring that economic crimes are punished according to law, we also standardize the exercise of the functions and powers of public security organs and procuratorial organs, and effectively protect the legitimate rights and interests of citizens, legal persons and other organizations from infringement.

The issuance and implementation of the standards for filing and prosecution (II) is a major measure taken by the Supreme People's Procuratorate and the Ministry of public security to implement the central deployment and serve the overall situation of national economic construction. It is a specific measure taken by public security and procuratorial organs to ensure people's livelihood, growth and stability, give full play to their functions and roles, and further promote the "three key tasks" and "three construction". The issuance and implementation of the standards for filing and prosecution (II) is conducive to promoting the standardization of law enforcement by public security organs and procuratorial organs, standardizing the filing and prosecution activities, improving the level and efficiency of law enforcement, promoting fair and honest law enforcement, facilitating the connection between administrative law enforcement and criminal justice, promoting the resolution of social contradictions and social management innovation, deterring criminals, further punishing economic crimes according to law, and ensuring national economic security, Promoting the healthy and orderly development of the socialist market economy will play a positive role.
