Mr. Lu worked with Huawei company, ZTE corporation and General Electric company for around 20 years and is familiar with industries of telecommunication, healthcare, aviation and enery.  Mr. Lu is of intensive understanding and rich practice with respect to interllectrual property (IP), corporate governance and dispute resolution.

As to coporate IP management, he formulated inside and outside workflows, risk control strategy, and quality control process; as to IP practices, he drafted and prosecuted thousands of patent applications, participated in invalidation and litigation against competitors, drafted and reviewed contracts.

Dozens of articles relating to IP and law written by Mr. Lu were published in journals and network platforms, such as “China Intellectual Property”, “Patent Agency”.

Typical cases

1. Negotiated with reknown telecomnication giants for patent licensing, including licensed patents, licensed products, territory, comparison of royalty rates, license type and license term.

2. Coordinated with R&D and marketing departments of companies to evaluate and thereby categorize patent assets for possible business negotiation and litigation.

3. Set up and streamlined the IP workflow based on quality management methodology of Six Sigma, formulated standard files inlcuding guidance, template, best practice, etc.

4. Drafted and prosecuted thosands of patent applications, involving Chinese and oversea patent applications, whereby setting up global portfolio for patent protection.

5. In view of a U.S. buyer’s requirements for freedom to operation in the process of a Chinese company exported its products to the U.S., Mr. Lu identified the solution of the products, retrieved and analysed prior art solutions from a large number of patent literatures, compared these solutions, and provided the resultant legal opinions.

6. Participated in a patent infringement case for the defendant, which was sued by a NPE located in Shenzhen, formulated a systemic policy, including filing a patent invalidation proceeding against the allowed patent owned by the NPE, preparing the grounds of defense for the infringement proceeding; as a result, the plantiff withdrew the lawsuit after the oral hearing of the invalidation.
